Every US-based AI training platform — including Mercor, Outlier AI, and DataAnnotation.tech — asks non-US contractors to complete a W-8BEN form during onboarding. For many EU-based contractors, this is the single most confusing administrative step. Here's what it actually is and how to handle it.
What the W-8BEN Is
The W-8BEN ("Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting") is a US IRS form used by non-US persons to certify their foreign status. US companies are generally required to withhold 30% of payments to non-US persons unless a tax treaty reduces or eliminates that withholding. Completing the W-8BEN correctly allows you to claim the applicable treaty benefit — for German residents, this generally means 0% US withholding tax on freelance service income.
Does This Mean I Owe No Tax?
No — and this is the most important clarification. Completing the W-8BEN correctly exempts you from US withholding tax, but you still owe tax in Germany on the income you earn. What Information the Form Requires
The W-8BEN (individual version) asks for:
- Your full legal name
- Country of citizenship (Germany for German citizens)
- Permanent residence address — your German address, not a PO box
- Tax treaty claim — you'll select Germany as the treaty country; most platforms have this as a dropdown
- Article and paragraph — typically Article 15 of the US-Germany tax treaty covers independent personal services
- Signature and date
Most platforms handle this through an online wizard (Stripe, Tipalti, or their own onboarding flow) that walks you through the form fields without requiring you to download the IRS form directly.
You do not need a US Tax Identification Number (TIN) if you have no US income-generating presence — leave that field blank or enter "N/A" as the platform instructs. Do not attempt to apply for a US ITIN just to fill this form unless specifically advised by a professional.
How Long It Stays Valid
A W-8BEN is generally valid for the calendar year it is signed and the following three calendar years — so a form signed in 2026 typically stays valid through 2029. Platforms will notify you when renewal is required.
What Happens If You Don't Submit It
If you fail to submit a W-8BEN, the platform is required by US law to withhold 30% of your payments by default — meaning you'd receive only 70% of what you earned until the form is submitted. This is recoverable in theory (you can claim the withheld amount via a US tax return), but the process is complex and slow. The far simpler path is submitting the form during onboarding before your first payout.

On Outlier AI and DataAnnotation.tech, it typically appears as a dedicated step in their contractor onboarding.
